Q How much does a divorce / civil partnership dissolution cost on an undefended basis?
A Between £800.00 and £1000.00 inclusive of VAT and disbursements. This is on the basis that there are no procedural difficulties. If there are, additional costs may be charged.
Q Will the other party pay the costs for my divorce?
A If you are blaming the other party for your divorce, it is usual to ask them to pay your divorce / civil partnership dissolution costs. Often, the question of costs is compromised with an agreement that half the costs are paid, or in certain circumstances, no costs at all are paid by the other party so as to ensure that the divorce proceeds as smoothly and as swiftly as possible.
Q Will I need to attend court?
A It is very unusual for a party to have to attend court for the purpose of a divorce / civil partnership dissolution and a decree is usually obtained by dealing with all of the paperwork through the post.
Q If I have a dispute, do I have to go and see a solicitor?
A It is not compulsory for you to have a solicitor to deal with any aspect of family law. It is, of course, sensible for you to take expert advice on any area relating to the family since often difficult decisions have to be made at times of extreme stress and it is far better to take independent specialist advice so that you can make an informed decision on matters that may ultimately affect the rest of your life.
Q How long do matters generally take to resolve?
A This is impossible to say. We will endeavour to achieve a sensible and amicable solution for you as swiftly as possible. It does however, take two to reach a compromise on any matter and therefore we will be relying on the good sense of the other party to either make sensible proposals or to accept sensible proposals we make on your behalf.
Q Will you tell me what to do?
A No we will not. We will offer you advice. We will assess with you the pros and cons of any potential course of action. But ultimately you will be the one who will make the decision and instruct us as to what you want to do and how you want to achieve it.
Q Do I need to go to court to get an injunction?
A Yes you do, but in appropriate circumstances special arrangements can be made for you to give evidence so that you do not come into contact with the other party.
Q How long does an injunction last?
A Usually six to twelve months, but it can be renewed if necessary.
Q Will you give advice over the telephone?
A Obviously being a busy practice we operate an appointments system. Our clients are free to telephone us to raise various queries during their case and where we know we only need a short meeting with the client, this is often done by telephone. Initial and substantive interviews are conducted at the office since we need to manage the time that we have available for our clients overall.
Q Will you do outside visits?
A In appropriate circumstances we will but this is usually when the client is too ill to attend the office or is disabled and unable to attend the office.
Q Do you have disabled facilities?
A We have a ground floor conference room available should wheelchair access be required.
